Cardholder Agreement

Important Notice
This document contains the terms and conditions governing your HL Hunt Credit Card account. Please read it carefully and keep it for your records. By using your card, you agree to be bound by these terms.
Interest Rates and Interest Charges
| Annual Percentage Rate (APR) for Purchases | 17.99% to 26.99%, based on your creditworthiness when you open your account. This APR will vary with the market based on the Prime Rate. |
| APR for Balance Transfers | 17.99% to 26.99%, based on your creditworthiness when you open your account. This APR will vary with the market based on the Prime Rate. |
| APR for Cash Advances | 26.99%. This APR will vary with the market based on the Prime Rate. |
| Penalty APR and When It Applies | 29.99%. This APR will vary with the market based on the Prime Rate. This APR may be applied to your account if you make a late payment. How Long Will the Penalty APR Apply? If your APRs are increased for this reason, the Penalty APR may apply indefinitely. |
| How to Avoid Paying Interest on Purchases | Your due date is at least 25 days after the close of each billing cycle. We will not charge you interest on purchases if you pay your entire balance by the due date each month. |

1. Definitions
In this Agreement, the following terms have these meanings:
- "Account" means your HL Hunt Credit Card account with us.
- "Agreement" means this Cardholder Agreement and any amendments.
- "Card" means any credit card or access device we issue to you for use with your Account.
- "We," "us," "our" means the issuing bank and HL Hunt Credit Corporation.
- "You," "your" means the person or persons responsible for the Account.
- "Authorized User" means any person you have authorized to use your Account.
- "Billing Cycle" means the period of time between billing statements.
2. Using Your Account
You may use your Card to make purchases, obtain cash advances, and transfer balances, subject to the terms of this Agreement and your available credit limit. By using your Card or Account, or by authorizing others to use your Card or Account, you agree to pay for all charges, including:
- All purchases made with your Card or Account number
- All cash advances obtained with your Card or Account
- All balance transfers to your Account
- All interest charges and fees as described in this Agreement
- All charges made by Authorized Users
3. Credit Limit
We will assign a credit limit to your Account based on your creditworthiness. Your credit limit is the maximum amount you may owe at any time. We may increase or decrease your credit limit at any time without prior notice, unless required by law.
If you exceed your credit limit, we may decline transactions, charge an over-limit fee (where permitted by law), or allow the transaction at our discretion. You are responsible for any amount that exceeds your credit limit.
4. Payments
You must pay at least the Minimum Payment Due by the Payment Due Date shown on each billing statement. The Minimum Payment Due is calculated as the greater of:
- $35 or your total New Balance if less than $35, or
- 1% of your New Balance plus any interest charges, fees, and past due amounts
Payments must be made in U.S. dollars. Payments may be made online, by phone, by mail, or through automatic payment. If you pay by mail, allow sufficient time for delivery before the due date.
Payment Allocation: We apply payments equal to the Minimum Payment Due in any order we choose. Amounts paid in excess of the Minimum Payment Due will be applied to balances with the highest APR first.
5. Interest Charges
We calculate interest charges using the Average Daily Balance method, including new transactions. The Average Daily Balance is calculated by taking the beginning balance each day, adding new transactions and fees, subtracting payments and credits, and then dividing the sum of all daily balances by the number of days in the billing cycle.
Grace Period: We will not charge interest on new purchases if you paid your previous balance in full by the due date. There is no grace period for cash advances. Interest on cash advances begins accruing from the date of the transaction.
6. Default
You are in default if you:
- Fail to make at least the Minimum Payment Due by the Payment Due Date
- Exceed your credit limit without our permission
- Make a payment that is returned unpaid
- Provide false or misleading information to us
- File for bankruptcy or become subject to insolvency proceedings
- Die or become legally incapacitated
- Violate any term of this Agreement
If you default, we may close your Account, require immediate payment of your entire balance, and/or apply the Penalty APR to your Account.
7. Unauthorized Use and Lost or Stolen Cards
If your Card is lost or stolen, or if you believe someone has used or may use your Card or Account without your permission, call us immediately at 1-800-HUNT-CREDIT (1-800-486-8273).
Zero Liability Protection: You will not be held responsible for unauthorized transactions on your Account if you notify us promptly and have exercised reasonable care in safeguarding your Card.
8. Disputes and Errors
If you believe there is an error on your statement or have a question about a transaction, write to us at the address shown on your statement within 60 days after the statement containing the error or question was sent. Include your name and Account number, the dollar amount of the suspected error, and a description of the error and why you believe it is an error.
While we investigate, you are not required to pay the amount in question, but you are still obligated to pay the parts of your bill that are not in question. We will complete our investigation within 90 days.
9. Rewards Program
Your Account may be enrolled in a rewards program. The terms and conditions of the rewards program are provided separately and are incorporated into this Agreement by reference. We reserve the right to change, suspend, or terminate the rewards program at any time.
10. Changes to This Agreement
We may change the terms of this Agreement, including APRs and fees, at any time. When required by law, we will give you advance written notice of changes. If we increase your APR for future transactions, the new rate will apply only to transactions made after the effective date of the change. Continued use of your Account after the effective date of any change means you accept the change.
11. Closing Your Account
You may close your Account at any time by calling us or writing to us. We may close or suspend your Account at any time without prior notice, unless required by law. If your Account is closed, you must destroy all Cards and remain responsible for paying any outstanding balance according to the terms of this Agreement.
12. Arbitration Agreement
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
You and we agree that any claim, dispute, or controversy arising from or relating to this Agreement or your Account shall be resolved by binding individual arbitration rather than in court, except for claims brought in small claims court. Arbitration shall be conducted by the American Arbitration Association under its Consumer Arbitration Rules.
CLASS ACTION WAIVER: YOU AND WE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR OUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.
13. Governing Law
This Agreement is governed by federal law and, to the extent state law applies, the laws of the State of Texas, without regard to its conflict of law principles.
