1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "your") and HL Hunt Credit Corporation, together with its subsidiaries and affiliates ("HL Hunt Credit," "we," "us," or "our"). These Terms govern your access to and use of our website, mobile applications, and related services (collectively, the "Services").

By accessing or using our Services, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you are accessing or using the Services on behalf of a business entity, you represent and warrant that you have the authority to bind that entity to these Terms.

2. Description of Services

HL Hunt Credit is a financial technology company that offers credit card products and related financial services. Our Services include:

• Consumer and business credit card products issued by our banking partners
• Online account management and mobile applications
• Rewards programs and redemption services
• Customer support and account services
• Financial tools and educational resources

Credit cards are issued by our partner financial institutions. Use of credit card products is governed by the applicable Cardholder Agreement provided at the time of account opening.

3. Account Registration

To access certain features of our Services, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security and confidentiality of your login credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access or use

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for fraudulent or unauthorized purposes.

4. Credit Card Applications

When you apply for a credit card through our Services:

• You authorize us and our banking partners to obtain credit reports and verify your information
• You certify that all information provided in your application is true and accurate
• You understand that approval is subject to credit review and is not guaranteed
• You agree to the terms of the applicable Cardholder Agreement if approved

Submitting an application does not obligate you to accept any credit card offer. You may decline any offer within the timeframe specified in the offer terms.

5. Acceptable Use

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable federal, state, local, or international laws or regulations
• Impersonate or attempt to impersonate another person or entity
• Engage in any conduct that restricts or inhibits anyone from using the Services
• Attempt to gain unauthorized access to any systems or networks
• Use automated means to access or interact with the Services without our permission
• Transmit viruses, malware, or other harmful code
• Interfere with or disrupt the integrity or performance of the Services
• Engage in fraudulent activity or provide false or misleading information

6. Intellectual Property Rights

The Services and all content, features, and functionality (including but not limited to all information, software, text, displays, images, video, audio, design, selection, and arrangement) are owned by HL Hunt Credit, its licensors, or other providers and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. This license does not include the right to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any content obtained from the Services.

7. Third-Party Links and Services

The Services may contain links to third-party websites, services, or content that are not owned or controlled by HL Hunt Credit. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

You acknowledge and agree that HL Hunt Credit shall not be responsible or liable, directly or indirectly, for any damage or loss caused by or in connection with the use of any such content, goods, or services available on or through any third-party websites or services.

8. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, HL HUNT CREDIT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

HL Hunt Credit does not warrant that the Services will be uninterrupted, secure, or error-free, that defects will be corrected, or that the Services or the servers that make them available are free of viruses or other harmful components.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HL HUNT CREDIT, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICES EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE MONTHS.

10. Indemnification

You agree to defend, indemnify, and hold harmless HL Hunt Credit, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

11. Electronic Communications

By using the Services, you consent to receive electronic communications from us. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

You may withdraw your consent to receive electronic communications by contacting us, but this may result in termination of your account or certain services.

12. Modifications to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through the Services or by other means. Your continued use of the Services after the effective date of any changes constitutes your acceptance of the modified Terms.

13. Termination

We may terminate or suspend your access to all or part of the Services, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease.

All provisions of these Terms which by their nature should survive termination shall survive termination, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Subject to the arbitration agreement below, you agree to submit to the personal and exclusive jurisdiction of the courts located in Dallas County, Texas.

15. Arbitration Agreement and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and HL Hunt Credit agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be resolved through binding individual arbitration rather than in court, except that either party may bring claims in small claims court if eligible.

CLASS ACTION WAIVER: YOU AND HL HUNT CREDIT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Arbitration shall be administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted in Dallas, Texas, unless the parties agree otherwise.

16. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its intent.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and HL Hunt Credit concerning the Services and supersede all prior or contemporaneous communications, proposals, and agreements, whether electronic, oral, or written.
